La reincorporación de los miembros de las Instituciones de Seguridad Pública (Estado de México)
<p>En este artículo se expone y explica la reforma constitucional al artículo 123 apartado B fracción XIII de la Constitución Política de los Estados Unidos Mexicanos, la cual desde su génesis partió de la prohibición de reincorporar al miembro de la institución de seguridad pública que fuese separado de su cargo, pese a haber promovido medio de defensa legal y constitucional en el que se haya determinado la baja, cese, remoción, separación o cualquier otra forma de terminación del servicio injustificada, pues el legislador tomó en consideración, como motivo de la medida, el denominado interés general, depuración de las instituciones y erradicación de la corrupción, medidas que sin duda dejan en deplorable estado de incertidumbre y menoscabo de los derechos humanos de este tipo de personas diferenciadas de las demás por el tipo de régimen que ostentan. En ese sentido, se hace necesaria la implementación de un método integrador del derecho, para que a través de lineamientos o pautas como el test de proporcionalidad y principio pro persona, la autoridad jurisdiccional pueda optar por la reincorporación del miembro de la institución de seguridad pública, al verse afectado alguno de sus derechos humanos, cuya prohibición y restricción no se encuentra justificada para con dicha persona y así se logre una verdadera protección y se materialice la justicia en nuestro sistema jurídico.</p>
